These Terms and Conditions of Use (the “Terms and Conditions” or “Terms”) govern the use of ForestsOntario.ca, frc-rfc.ca, GrasslandsOntario.ca, ItTakesAForest.ca, TreesTakeRoot.ca and TreeBee.ca (“Websites”). The Websites are owned and operated by Forests Ontario.

By accessing and using the Websites, you indicate that you have read, agree to, and understand these Terms and Conditions. If you do not agree with these Terms, you must exit our Websites and not access additional pages.

All personal information you provide will be collected, used, and disclosed in accordance with our privacy policy, which can be found link to Privacy Policy.

Intellectual Property

All content published and made available on our Websites is copyrighted under Canadian copyright laws and are the property of Forests Ontario. This includes, but is not limited to images, text, logos, documents, downloadable files and anything that contributes to the composition of our Websites. You may not modify or delete or create derivative works of our content unless you have our permission or as may be permissible under Canadian fair dealing rules. If we do not display specific restrictions you may make copies of specific portions of the content but only for personal use.

The emblems, logos, graphics, and names pertaining to Forests Ontario and the Websites are trademarks, registered or otherwise, of Forests Ontario and may not be used in any manner that may cause confusion among customers, donors, or other members of the public. Only Forests Ontario has the right to use these marks.

Accounts

When you create an account on our Websites, you agree to the following:

  1. You are solely responsible for your account and the security and privacy of your account, including passwords or sensitive information attached to that account;
  2. You agree to not share your account password with anyone; and
  3. All personal information you provide to us through your account is up to date, accurate and truthful and that you will update your personal information if it changes.

We reserve the right to suspend, cancel or terminate your account if you are using our Websites illegally or if you violate any aspect of these Terms and Conditions, with or without notice to you.

Our Websites may offer goods and services from third parties. We cannot guarantee the quality or accuracy of goods and services made available by third parties on our Websites.

Our Websites contain links to third party websites or services that we do not own or control. We are not responsible for the content, policies or practices of any third-party website or service linked to our Websites. It is your responsibility to read the terms and conditions and privacy policies of these third-party websites before using them.

Disclaimer and Limitation of Liability

Our Websites are presented “AS IS.” We make no warranties about the operation of the Websites and disclaim all warranties, whether express or implied, statutory or otherwise. Forests Ontario does not warrant that use of the Websites will be uninterrupted or error-free. To the greatest extent permissible under applicable law, we and our directors, officers, agents, employees, subsidiaries, and affiliates will not be liable for any actions, claims, losses, damages, liabilities and expenses including legal fees from your use of the Websites.  Forests Ontario makes no representation that content provided on our Websites is applicable or appropriate for use in locations outside of Canada.

Indemnity

Except where prohibited by law, by using the Websites you indemnify and hold harmless Forests Ontario and our directors, officers, agents, employees, subsidiaries, and affiliates from any actions, claims, losses, damages, liabilities and expenses including legal fees arising out of your use of our Websites or your violation of these Terms and Conditions.

Governing Law

These Terms and Conditions are governed by the laws of the Province of Ontario and the federal laws applicable therein. Any disputes regarding your use and access of the Websites shall be brought before the Courts located in the City of Toronto.

Prohibited Conduct

You may not access or use, or attempt to access or use, the Websites to harm us or any other person, interfere with the operation of the Website, or use it in a manner that violates any applicable laws, including but not limited to the following:

  • You may not impersonate anyone or misrepresent your credentials;
  • You may not scrape or harvest any content available on the Websites;
  • You may not attempt to interfere with the services provided on the Websites;
  • You may not scan or test vulnerabilities of the Websites or disrupt or interfere with the Websites; and
  • You may not upload any virus, worm, Trojan horse, time bomb, malware, or any other code intended to damage any hardware or software or operations.

Severability

If at any time any of the provisions set forth in these Terms and Conditions are found to be inconsistent or invalid under applicable laws, those provisions will be deemed void and will be removed from these Terms and Conditions. All other provisions will not be affected by the removal and the rest of these Terms and Conditions will still be considered valid.

Changes

These Terms and Conditions may be amended from time to time in order to maintain compliance with the law and to reflect any changes to the way we operate our Websites and the way we expect users to behave on our Websites. It is your responsibility to review the Terms for any changes prior to accessing our Websites.
